Terms of service

Effective 1 January 2026. These terms form a binding agreement between you and Curiosityjivar Labs Ltd covering your use of curiosityjivar.click and the Curiosityjivar generator.

1. Acceptance

By accessing curiosityjivar.click, using the generator, or submitting an enquiry through the contact form, you accept these terms. If you do not accept them, do not use the site. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

2. The service

The site provides an in-browser colour system generator together with written guidance on palette construction, contrast, theming and token export. The service is provided on an as-available basis. We may add, change, suspend or withdraw features at any time, and we may impose reasonable technical limits on automated access to protect availability.

3. Your obligations

  • Use the site only for lawful purposes and in accordance with these terms.
  • Do not attempt to gain unauthorised access to any part of the site, its servers, or any connected system.
  • Do not scrape, mirror, crawl at a rate likely to degrade service, or systematically extract content for republication.
  • Do not introduce malware, attempt denial of service, or interfere with other users' access.
  • Do not submit unlawful, defamatory, infringing or deliberately misleading content through the contact form.
  • Do not remove, obscure or alter any proprietary notice on the site.

You are responsible for any activity carried out through your connection and for ensuring that anyone using the site on your behalf complies with these terms.

4. Intellectual property

The site's source code, written guides, layout, graphics, the Curiosityjivar name and the Curiosityjivar mark are owned by Curiosityjivar Labs Ltd or licensed to us, and are protected by copyright, trade mark and other intellectual property laws. You may view the site, and you may quote short extracts of the written guides with clear attribution and a link to the source page. You may not reproduce a guide in full, republish substantial portions, or use our name or mark in a way that suggests endorsement.

Your output. Colour values, palettes and token files you generate are yours to use, including commercially, with no attribution required and no licence fee. Individual colour values are not in themselves protectable by copyright, and we make no claim over them. We make no representation that a generated palette does not resemble the branding of a third party; checking for conflicts with existing trade dress or trade marks is your responsibility.

5. Third-party links

The site links to external resources such as standards bodies and regulators. Those sites are outside our control. We include links because we consider the destinations useful, not as an endorsement of everything they contain, and we accept no responsibility for their content or availability.

6. Disclaimer of warranties

The site and the generator are provided "as is" and "as available". To the fullest extent permitted by law we exclude all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. In particular, we do not warrant that the site will be uninterrupted or error free, that the guidance is suitable for your specific project, or that a generated palette will satisfy any particular legal, regulatory or accessibility requirement. Automated contrast figures are calculated using the published WCAG formula and are an aid to review, not a certification of conformance. You remain responsible for testing your own product.

7. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited. Subject to that, we shall not be liable for loss of profits, loss of business, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect or consequential loss, however arising. Our total aggregate liability arising out of or in connection with your use of the site shall not exceed one hundred pounds sterling (£100) or, if greater, the total amount you have paid us in the twelve months preceding the claim.

8. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your unlawful use of the site, or your infringement of a third party's rights through the material you submit to us.

9. Termination

We may suspend or terminate your access immediately and without notice if we reasonably believe you have breached these terms, if your use poses a security or availability risk, or if we are required to do so by law. You may stop using the site at any time. Sections concerning intellectual property, disclaimers, liability, indemnity and governing law survive termination.

10. Changes to these terms

We may revise these terms from time to time. The version published on this page at the moment you use the site is the version that applies. Where changes are material we will update the effective date at the top of the page. Continuing to use the site after a change constitutes acceptance.

11. Governing law and disputes

These terms and any non-contractual obligations arising out of them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK or in the EEA you may also bring proceedings in your country of residence, and mandatory consumer protections of your home jurisdiction are unaffected.

Before starting proceedings we ask that you contact us at [email protected] so we can attempt to resolve the matter informally. Most disputes are resolved this way within a few weeks.

12. General

If any provision is held unenforceable, the remainder continues in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy and cookie policy, constitute the entire agreement between us in relation to the site. A person who is not a party to these terms has no right to enforce them.
